Why after health declaration was done properly, still there were cases that Insurance Companies reject a claim ?
Because customer thought the health declaration was being done properly, but actually it WAS NOT (customer’s negligence) – that’s why insurer can reject the claim without repercussions
…and even if customer brings the matter up to the regulator, customer still loses.
There was one recent case where a businesswoman sue Great Eastern to court for not paying Rm 500 Million because the latter claims that the former didin’t declared certain health conditions. According to press report, Great Eastern pay ( out of court settement ) to the woman.
So as you can see, it's like what we mentioned 'customer thought the health declaration was being done properly, but actually it WAS NOT'
But of course you have the right to hire legal firm and sue insurer. Even murderers with the financial means can hire lawyers to escape from the punishment of law - the caveat is - whether you have the financial means to do so.
Say, if it's a 500 mil compensation, and you have 50 mil in your bank account, of course spending 5 mil to hire lawyers to sue the insurer make sense.
But even if you have 5 mil in your bank account, does spending 5 mil to sue the insurer make sense or not? Only you can answer that, not anyone. What if you lose the case?
Of course insurer will see who they are dealing with. Their first reply would always be customer negligence. But when they realize the customer they are dealing with is a 'somebody', then also want to keep things low profile in order not to tarnish the business reputation (hence what you mentioned - 'out of court settlement')
So the question is, are you a somebody with that level of financial means like the biz woman you mentioned? If yes, congrats, you have nothing to worry about even if insurer screwed you left and right.
Because for every 1 person like the biz woman who successfully 'cari pasal' with insurer, there are 99 people out there who can't do anything.
