Dear Mr Lieu,
When a person negligently omitted certain illness and later his hospitalisation  claim was being rejected because of non disclosure, can the insurance company be taken to court ?. Reason is because the insured person is negligently omitted and not intentionally ommited the said disclosure ?  But how the court going to prove which one ?

Edson, the simpler analogy to your question is this:
~After you signed on a S&P agreement and the loan agreement with bank, do you think you have a case against the property developer and the banks in court with the reason -

"I didn't fully read or fully understand certain terms & conditions of the contract when I signed it"

...when you feel you have been screwed by the developers/banks?
